Delivery & Service Disclaimer

American Topsoil

American Topsoil is a family-owned service business. We take care to complete each job safely and professionally, but topsoil delivery involves heavy equipment and conditions that are often outside our control. By scheduling service, the customer agrees to the following conditions.

Heavy Equipment and Access

American Topsoil uses heavy machinery such as dump trucks and power wheelbarrows.

  • These machines are heavy and may cause cracking, rutting, or other damage to:

    • Driveways

    • Sidewalks

    • Curbs

    • Lawns

    • Sprinkler systems

    • Underground utilities

    • Septic systems or drain fields

  • Delivery or work performed inside the curb line or off the street is done solely at the customer’s risk.

American Topsoil is not responsible for surface or underground damage unless caused by proven negligence.

Customer Responsibility for Site Conditions

To complete the work safely and efficiently:

  • The designated work and delivery areas must be clean, clear, and accessible.

  • Customers must:

    • Remove vehicles, toys, hoses, tools, and other obstacles

    • Mark or disclose sprinkler heads, underground lines, or sensitive areas

    • Ensure gates, fences, and access points are wide enough for equipment

American Topsoil is not responsible for damage to:

  • Unmarked sprinkler systems

  • Invisible or buried utilities

  • Hidden structures

  • Weak or deteriorated surfaces

Material Placement and Spreading

  • Topsoil is spread at the time of delivery only.

  • Our equipment is loaded directly from the truck, so we cannot return later to spread the same material.

  • Material will be placed in the location agreed upon at the time of service.

If the customer requests placement in areas with limited access (such as behind fences or under decks), additional labor charges may apply.
Any additional charges will be discussed before the work is performed.

Existing Materials and Debris

American Topsoil does not remove existing materials before placing topsoil, including:

  • Mulch

  • Rock

  • Old soil

  • Landscaping debris

  • Construction debris

If the customer wants these materials removed, it is the customer’s responsibility to clear the area before delivery.

No Excavation or Major Grading

American Topsoil provides topsoil delivery and spreading only. We bring in new soil and install it where requested.

  • We do not perform excavation

  • We do not remove or cut down existing high areas of soil.

If an area needs to be lowered, dug out, or re-graded before topsoil is added, that work must be completed by the customer or a separate contractor before our delivery.

Our service is limited to adding and spreading new topsoil over the existing surface.

Soil Behavior and Weather Conditions

Topsoil is a natural material and will settle over time.

American Topsoil is not responsible for:

  • Soil settling

  • Soil compaction

  • Erosion

  • Washout from rain or irrigation

  • Changes caused by weather or drainage conditions

  • Plant or grass performance after installation

Proper care, watering, and maintenance are the customer’s responsibility.

Quantity and Measurement

We do our best to estimate material quantities accurately.

  • Final quantities may vary due to:

    • Site conditions

    • Settling

    • Customer-directed placement

  • Customers are charged only for the amount of material actually delivered and used.

Delays and Access Issues

If the job cannot be completed due to:

  • Blocked access

  • Unsafe conditions

  • Weather

  • Customer not present when required

Additional charges or rescheduling may apply.

Acceptance of Service

By scheduling or accepting delivery, the customer acknowledges:

  • The risks associated with heavy equipment

  • Responsibility for site preparation

  • The conditions listed above
